Judge Rejects xAI Bid to Pause Minnesota’s “Nudify” App Ban

Minnesota’s ban on apps that let users digitally “nudify” images took effect on August 1, 2026, after U.S. District Judge Donovan Frank denied xAI’s request for a temporary restraining order. The measure is the first state law of its kind in the United States.

Why the decision matters

The ruling allows Minnesota to enforce the ban while xAI’s broader lawsuit continues. It does not settle the company’s challenge or determine whether the statute will ultimately survive judicial review.

The case directly concerns services capable of producing non-consensual sexual imagery. It also raises a wider question for AI developers and platforms: whether states can prohibit a category of applications when providers argue that narrower safeguards could address the same harm.

Earlier in 2026, users of X employed xAI’s Grok chatbot to flood the platform with non-consensual sexual images. The episode prompted investigations and bans, intensifying scrutiny of how generative AI services prevent, detect and remove abusive material.

Timing weakened xAI’s emergency request

Frank focused substantially on when xAI sought emergency relief. The company filed its request on July 29, nearly three months after the law was signed and only three days before its August 1 effective date.

“Such a delay in bringing the action and the motion suggests that harm is not immediate,” Frank wrote.

xAI contends that Minnesota’s ban is “overinclusive” and that “far less restrictive alternatives” could achieve the same objective. Those arguments remain part of the continuing lawsuit, even though they did not persuade the court to pause enforcement at this stage.

The corporate context is also notable: X and xAI are now part of SpaceX. That structure concentrates responsibility for model behavior, platform distribution and regulatory exposure within the same corporate group.

For businesses deploying generative image tools, the practical lesson is to treat consent controls, abuse monitoring, rapid takedowns and state-by-state legal reviews as launch requirements. Waiting until an enforcement deadline to challenge a rule may leave a service operating under restrictions while litigation proceeds.
