Federal Judge Weighs Permanent Block on Anthropic Ban

At a Thursday hearing, U.S. District Judge Rita Lin said the Trump administration had not shown enough evidence to label Anthropic a supply chain risk or bar federal use of its technology.

The hearing covered one of two lawsuits Anthropic filed against the Department of Defense in March. Lin is weighing whether to make her temporary block permanent.

From contract talks to a ban

The dispute grew out of stalled contract negotiations between Anthropic and the Department of Defense.

Anthropic said it did not want its AI used for mass surveillance of Americans or for targeting or firing decisions involving lethal weapons because the technology was not ready.

The Pentagon said a private company should not dictate military use of technology and that its use of the tools would be lawful.

Claims tested in court

The government argued that Anthropic's public criticism of the DoD also justified the ban. Lin called that logic really troubling, warning that it could create a precedent for retaliation against federal contractors that disagree with the administration.

The DoD also claimed Anthropic might disable or alter its AI models during warfighting operations. Experts said that assertion lacked evidence. Lin likewise said she saw no proof that Anthropic could change a delivered model or flip some kind of kill switch.

Through two lawsuits filed in March, Anthropic is challenging the US ban on Anthropic models and the associated supply chain risk designation. Thursday's hearing concerned one case; the other is being heard in Washington.

What businesses should track

Lin temporarily blocked the ban in March and is deciding whether that order should become permanent. The remaining questions concern control over a delivered model, the basis for a supplier restriction, and whether criticism of an agency can justify exclusion.

For businesses negotiating government AI contracts, the practical task is to define permitted uses and post-delivery control in writing. Buyers and suppliers should preserve technical evidence showing whether a deployed model can be altered or disabled, alongside the record supporting any security designation.
